FINDINGS OF FACT, RULINGS OF LAW, AND ORDER FOR JUDGMENT"For these reasons, the Court finds and rules that Abhais ANDA Product infringes Claim 1 of the 096 Patent and Claims 1, 11 (as it depends from Claims 1, 2, and 7), and 13 of the 148 Patent. Abhai never developed a viable evidentiary attack on the validity of either of Shires patents and the Court necessarily finds in Shires favor on Abhais counterclaims.These findings and rulings dispose of the claims before the Court.
