"...For the reasons stated above, the special motion to dismiss [ECF No. 21] is DENIED, and the motion to dismiss for failure to state a claim [ECF No. 19] is GRANTED IN PART AND DENIED IN PART. Specifically, it is granted with respect to Counts II (civil conspiracy), III (money had and received), V (breach of contract), and VI (intentional interference with advantageous business relationships), and denied with respect to Counts I (common law fraud) and IV (Chapter 93A).13 GEICO, however, may move for leave to amend its complaint with respect to the Counts II and VI (civil conspiracy and intentional interference).
