District Judge Leo T. Sorokin: ORDER entered.After de novo review of the 42 Report and Recommendation issued by Magistrate Judge Kelley and consideration of the objections filed by the Plaintiff (Doc. Nos. 44, 45 & 46), the Court hereby ADOPTS the 42 Report and Recommendation and ALLOWS the 39 Motion to Dismiss filed by Defendant Turco.
