Judge Mark G. Mastroianni: MEMORANDUM AND ORDER entered. For the foregoing reasons, the parties cross-motions for summary judgment - docs. [62[ and 68 are hereby ALLOWED to the extent they seek a ruling on the parties contractual obligations to each other. To the extent Jiminy sought summary judgment as to its common law claims for indemnification and contribution against Wiegand, its motion is DENIED. The parties are directed to notify the court in writing within thirty (30) days of this ruling whether they wish to pursue their common law claims. Finally, while the court has determined both parties owe each other a duty to defend and indemnify, neither party, at this stage, had reason to raise the issue of the amount each party might owe the other. The parties are, therefore, also directed to notify the court within thirty (30) days of this order how they wish to proceed to establish the amounts owed by each party under its respective duty to defend and indemify.
