Judge Mark G. Mastroianni: MEMORANDUM AND ORDER entered. As follows: For the reasons stated, the court ALLOWS Cosbys motion for judgment on the pleadings, in part, insofar as it seeks a judgment that AIG owes Cosby a duty to defend. (Dkt. No. 110.) The court also DENIES AIGs Motion for Summary Judgment. (Dkt. No. 104.) In addition, the parties are hereby ORDERED to file a joint status report within thirty days discussing their positions regarding the appropriate procedure, if any, for resolving the duty to indemnify.
