ORDER: The Motion to Dismiss the Complaint (Doc. 8) filed by Defendants Nutramax, Rite-Aid, and Wal-Mart is granted in part. Plaintiff's request for injunctive relief is dismissed without prejudice as to Defendants Nutramax, Rite-Aid and Wal-Mart. Plaintiff's third claim, for breach of express warranty, is dismissed without prejudice as to Defendants Rite-Aid and Wal-Mart. In all other respects, the Motion to Dismiss is denied.
