REPORT AND RECOMMENDATION 1. That the Petition for a Writ of Habeas Corpus [Docket No. 1] be dismissed with prejudice as to Ground One, which alleges a violation of Due Process, because the issue has been procedurally defaulted. 2. That, with respect to Ground Two of the Petition, which alleges an unlawful civil commitment, as well as the involuntary administration of medication, be deferred for further briefing to address the merits of that claim. Objections to R&R due by 11/19/2007. Signed by Chief Magistrate Judge Raymond L. Erickson on 10/30/2007. (jc)
