REPORT AND RECOMMENDATION. IT IS HEREBY RECOMMENDED that: 1. Plaintiff Robert Iverss construed motion for summary judgment (Doc. Nos. 57, 59) be DENIED.2. Defendant CMFG Life Insurance Companys motion for summary judgment (Doc. No. 60) be GRANTED IN PART and DENIED IN PART. The motion should be denied as to Iverss claim for breach of contract and CMFGs claim for rescission, but granted as to Iverss remaining claims for promissory estoppel, equitable estoppel, and unjust enrichment. 3. Iverss claims for promissory estoppel, equitable estoppel, and unjust enrichment be DISMISSED WITH PREJUDICE. The only claim that would remain is Iverss claim for breach of contract.
