ORDER: (1) The Clerk of Court is directed to amend the Court's docket to remove the designation "on behalf of himself and all others similarly situated" as to Plaintiff Christopher M. Bartl. (2) Defendant Enhanced Recovery Company, LLC's motion to dismiss under Rule 12(b)(1) [Dkt. No. 46] is DENIED. (3) Plaintiff Christopher M. Bartl's motion for summary judgment [Dkt. No. 49] is GRANTED IN PART and DENIED IN PART. Summary judgment is granted in favor of Plaintiff Christopher M. Bartl as to Defendant Enhanced Recovery Company, LLCs liability under 15 U.S.C. ยง 1692g(b), as set forth in this Order.
