REPORT AND RECOMMENDATION re 11 MOTION to Dismiss/General for Failure to State a Claim filed by Federal Trade Commission, 20 MOTION to Stay MOTION to Compel filed by Verizon Wireless. IT IS HEREBY RECOMMENDED that: 1. The Federal Trade Commissions Motion to Dismiss for Failure to State a Claim upon which Relief may be Granted (Doc. No. 11) be GRANTED, and that all claims in the Complaint be dismissed without prejudice against the FTC; and 2. Verizon Wireless's Motion to Compel Arbitration and Stay the Action (Doc.
