ORDER ADOPTING REPORT AND RECOMMENDATION. IT IS HEREBY ORDERED THAT: 1.This action is DISMISSED IN PART WITH PREJUDICE and DISMISSED IN PART WITHOUT PREJUDICE as follows: a.
