OPINION MEMORANDUM re:2 MOTION for Leave to Proceed in forma pauperis under 42:1983 (prisoner) filed by Sammy L. Casey-El, motion is GRANTED. IS IS FURTHER ORDERED that plaintiff shall pay an Initial Partial Filing Fee of $8.13 within 30 days, due by 10/26/2005. IT IS FURTHER ORDERED that if plaintiff fails to pay the initial partial filing fee within 30 days, without good cause shown, the Court will dismiss this action without prejudice. IT IS FURTHER ORDERED that the Clerk shall not issue process upon the complaint as to defendant Caruthersville Police Department, because the claims against this defendant are legally frivolous or fail to state a claim upon which relief may be granted, or both. IT IS FURTHER ORDERED that, as to defendant Michael Coleman, the Clerk shall issue process or cause process to issue upon the complaint. IT IS FURTHER ORDERED that defendant Michael Coleman shall reply to the complaint within the time provided by the applicable provisions of Rule 12(a) of the FRCP.
