IT IS FURTHER ORDERED that Plaintiff Tyral Tinsley is designated as representativeof the class. ITMEMORANDUM AND ORDER..IT IS HEREBY ORDERED that Defendants Motion for Summary Judgment (Doc. 72) is granted in part and denied in part. Summary judgment is granted in favor of Defendants as to Plaintiff Janet Cargills claims. Summary judgment is denied as to the issue of preemption. A separate Partial Judgment will be issued on this date. IT IS FURTHER ORDERED that Plaintiffs Request to Continue Defendants Motion for Summary Judgment pursuant to Rule 56(d) (Doc. 84) is granted. Defendants Motion for Summary Judgment is stayed as to Defendants defenses of exemption and good faith. IT IS FURTHER ORDERED that the following briefing schedule shall apply: Plaintiffs shall file their Response to Defendants Motion for Summary Judgment on March 15, IS FURTHER ORDERED that The Owens Law Firm and the Employee & Labor Law Group of Kansas City are appointed as class counsel.IT IS FURTHER ORDERED that the parties shall confer and attempt to reachagreement with respect to a proposed form of class notice. Within 14 days from the date of this Order, the parties shall file a proposed notice, reflecting issuesif anyon which they are unable to reach agreement ( Response to Court due by 2/16/2016.)
