ORDER AND MEMORANDUM. ORDERED that plaintiff's motion for leave to proceed in forma pauperis 2 is GRANTED. FURTHER ORDERED that plaintiff shall pay an initial partial filing fee of $4.42 within thirty (30) days from the date of this order. Plaintiff is instructed to make his remittance payable to "Clerk, United States District Court," and to include upon it: (1) his name; (2) his prison registration number; (3) the case number; and (4) that the remittance is for an original proceeding. FURTHER ORDERED that the Clerk shall not issue process or cause process to issue upon the complaint, because the complaint is legally frivolous and/or fails to state a claim upon which relief may be granted. FURTHER ORDERED that plaintiff's motion to appoint counsel 3, second motion for leave to proceed in forma pauperis 6, and second motion to appoint counsel 7 are DENIED as moot. ORDER re:24 MOTION for Leave to Proceed in forma pauperis on appeal under 42:1983 (prisoner) filed by Plaintiff Michael A. Lococo motion is DENIED. IT IS FURTHER ORDERED that within thirty (30) days from the date of this order, plaintiff shall either pay to this Court the full $455 filing and docketing fees for an appeal or file with the United States Court of Appeal for the Eighth Circuit an application to proceed in forma pauperis on appeal. IT IS FURTHER ORDERED that plaintiff shall file any future documents or pleadings in connection with hie appeal directly with the United States Court of Appeal for the Eighth Circuit.
