Judgment Amended: Reduction of Sentence Re: Crack Cocaine Offense 18:3582 as to Danny Ray Jackson (1), Count(s) 1r, Upon motion of the defendant under 18 USC 3582(c)(2) for a reduction in the term of imprisonment imposed based on a guideline sentencing range that has subsequently been lowered and made retroactive by the United States Sentencing Commission pursuant to 28 USC 994(u), and having considered such motion, IT IS HEREBY ORDERED that the motion is DENIED. The defendant received a departure below the guideline range. However, his guideline range was not based on the crack cocaine guidelines, but rather the career offender guidelines under USSG Section 4B1.1, which is unaffected by the retroactive amendment under 18 USC 3582(c)(2). 31 MOTION for Retroactive Application of Sentencing Guidelines to Crack Cocaine Offense 18 USC 3582 filed by Danny Ray Jackson. Signed by Honorable Jean C. Hamilton on 8/6/08. (copy mailed to Defendant, USM, and USP) (TRC)
