ORDER ADOPTING REPORT AND RECOMMENDATIONS - IT IS HEREBY ORDERED that the Motion to Dismiss or in the Alternative Motion for Summary Judgment 10 filed by Defendant is DENIED. IT IS FURTHER ORDERED that Defendant shall serve and file an answer and the transcript of the administrative record, within 30 days of the date of this Order. IT IS FURTHER ORDERED that Plaintiff shall serve and file a brief, within 30 days after service of Defendant's answer and the transcript of the administrative record; Defendant shall serve and file a brief, within 30 days after service of Plaintiff's brief; and Plaintiff shall file a reply brief, within 10 days after service of Defendant's brief.
