ORDER - IT IS HEREBY ORDERED that plaintiff's motion for leave to proceed in forma pauperis 2 is HELD IN ABEYANCE. IT IS FURTHER ORDERED that plaintiff shall file a certified copy of his inmate trust fund account statement for the six month period immediately preceding the filing of his complaint on 4/23/07. IT IS FURTHER ORDERED that if applicant fails to submit a certified copy of his inmate trust fund account statement within 30 days, the Court will dismiss this action without prejudice. IT IS FURTHER ORDERED that if plaintiff submits his inmate trust fund account statement within 30 days, the Clerk shall resubmit this action for review. Response to Court due by 6/2/2007. MEMORANDUM AND ORDER - IT IS HEREBY ORDERED that plaintiff's motion to proceed in forma pauperis 2 is GRANTED. IT IS FURTHER ORDERED that the plaintiff shall pay an initial partial filing fee of $5.00 within 30 days from the date of this order. IT IS FURTHER ORDERED that the Clerk shall not issue process or cause process to issue upon the complaint as to defendants James and Chigurupati because the claims against these defendants are legally frivolous or fail to state a claim upon which relief may be granted or both.
