REPORT AND RECOMMENDATIONS :Interface has failed to establish that any of the five theories for binding a nonsignatory to an arbitration clause applies to LPS. Interface has also failed to establish that the forum selection clause should govern its relationship with LPS. For the reasons stated above, it is the recommendation of the undersigned United States Magistrate Judge that the motion of defendant Interface to dismiss the case and compel arbitration (Doc. 4) should be denied. The parties are advised that they have ten (10) days in which to file written objections to this Report and Recommendation.
