MEMORANDUM AND ORDER IT IS HEREBY ORDERED that plaintiffs motion for leave to proceed in forma pauperis is GRANTED. [Doc. 2] IT IS FURTHER ORDERED that plaintiffs motion to proceed without the necessity of filing an inmate account statement is GRANTED. [Doc. 6]. No initial partial filing fee shall beassessed against plaintiff at this time. IT IS FURTHER ORDERED that plaintiffs motion for appointment of counsel is DENIED as moot. [Doc. 3] IT IS FURTHER ORDERED that the Clerk shall not issue process or cause process to issue upon the complaint, because the complaint is legally frivolous and fails to state a claim upon which relief may be granted.
