REPORT AND RECOMMENDATIONS IT IS HEREBY RECOMMENDED that Defendant's Motion to Remand [Doc. #9] be GRANTED and this cause be reversed and remanded to the Commissioner pursuant to sentence four of 42 U.S.C. ยง 405(g). The parties are advised that they have eleven days in which to file written objections to this Report and Recommendation. Failure to timely file objections may result in waiver of the right to appeal the questions of fact. Thompson v. Nix, 897 F.2d 356, 357 (8th Cir. 1990). 15 1 13 Objections to R&R due by 11/17/2008. ORDER: IT IS HEREBY ORDERED that the Report and Recommendation of the Magistrate Judge 16 is adopted and incorporated herein. IT IS FURTHER ORDERED that Defendant's Motion to Reverse and Remand 15 is GRANTED. IT IS FURTHER ORDERED that, pursuant to Sentence Four of 42 USC 405(g), this matter is reversed and remanded to the Commissioner for further proceedings consistent with the Magistrate Judge's Report and Recommendation and with this Order.
