ORDER: IT IS HEREBY ORDERED that plaintiff's motion for an extension of time to pay the filing fee or in the alternative to stay all proceedings 7 is GRANTED IN PART and DENIED IN PART. Plaintiff is GRANTED forty-five (45) days from the date of this Order to pay the $350 filing fee. Plaintiff's request for an additional 120 days to pay the filing fee and his alternative motion to stay the instant proceedings are DENIED. IT IS FURTHER ORDERED that if plaintiff fails to pay the filing fee within forty-five (45) days from the date of this Order, the Court will dismiss this action, without prejudice.
