MEMORANDUM AND ORDER re: 4 PRO SE MOTION filed by Plaintiff Dallas R. Delay and 2 MOTION to Certify Class filed by Plaintiff Leon Williams, Plaintiff James Kain, Plaintiff Marvel A. Lowe, and Plaintiff Dallas R. Delay. IT IS HEREBY ORDERED that this action is DISMISSED without prejudice pursuant to 28 U.S.C. Section 1915A(b). IT IS FURTHER ORDERED that to the extent plaintiffs have plead state law claims, they are DISMISSED without prejudice pursuant to 28 U.S.C. Section 1367(c)(3). IT IS FURTHER ORDERED that the Clerk shall not issue process or cause process to issue upon the complaint because the complaint is legally frivolous or fails to state a claim upon which relief can be granted, or both. IT IS FURTHER ORDERED that plaintiffs shall file any future documents or pleadings in connection with their appeal directly with the United States Court of Appeals for the Eighth Circuit.
