MEMORANDUM AND ORDER (See Full Order) IT IS HEREBY ORDERED that the amended petition of Carman L. Deck for writ of habeas corpus 30 is granted as to the sentence of death only, based on Claims 31 and 32(a) as discussed above, and denied in all other respects. Petitioners death penalty is vacated. Because the constitutional deficiencies cannot be cured and Deck cannot now be subjected to a penalty-phase trial that comports with due process, he must be sentenced to life in prison without the possibility of parole.
