MEMORANDUM AND ORDER - IT IS HEREBY ORDERED that movant Steven Mueller's motion for evidentiary hearing is DENIED. (Doc. 10) IT IS FURTHER ORDERED that movant Steven Mueller's motion for leave to amend isDENIED. (Doc. 17) IT IS FURTHER ORDERED that movant Steven Mueller's Motion under 28 U.S.C. ยง 2255 to Vacate, Set Aside or Correct Sentence by a Person in Federal Custody is DENIED. IT IS FURTHER ORDERED that movant Steven Mueller has not made a substantial showing of the denial of a constitutional right such that reasonable jurists would find the Court's assessment of the constitutional claims debatable, or that reasonable jurists would find it debatable whether the Court was correct in its procedural rulings and, therefore, this Court will not issue a certificate of appealability on those claims. See Miller-El v. Cockrell, 537 U.S. 332, 338 (2003); Slack v. McDaniel, 529 U.S. 473, 484-85 (2000). An appropriate judgment will accompany this Memorandum and Order.
