MEMORANDUM AND ORDER - IT IS HEREBY ORDERED that defendant's motion for summary judgment [#13] is GRANTED IN PART and DENIED IN PART as set forth above. IT IS FURTHER ORDERED that plaintiffs motion for summary judgment on liability [#18] is GRANTED. The trial of this matter remains set on the two-week docket beginning April 11, 2016 and will consider only the amount of damage to which plaintiff is entitled, as that issue was not addressed by the motions.
