MEMORANDUM AND ORDER: IT IS HEREBY ORDERED that plaintiff's motion for leave to proceed in forma pauperis [Doc. #2] is GRANTED. IT IS FURTHER ORDERED that plaintiff shall pay an initial partial filing fee of $12.37 within thirty (30) days from the date of this Order. Plaintiff is instructed to make his remittance payable to "Clerk, United States District Court," and to include upon it: (1) his name; (2) his prison registration number; (3) the case number; and (4) that the remittance is for an original proceeding. IT IS FURTHER ORDERED that, consistent with the instructions set forth in this Memorandum and Order, plaintiff shall file an amended complaint within thirty (30) days from the date of this Order.1 IT IS FURTHER ORDERED that the Clerk shall mail to plaintiff the court-provided form for filing a prisoner complaint pursuant to 42 U.S.C. 1983. IT IS FURTHER ORDERED that plaintiff's failure to amend his complaint in accordance with this court's instructions will result in the dismissal of this action, without prejudice and without further notice. IT IS FURTHER ORDERED that plaintiff's motion for counsel [Doc. #3] is DENIED without prejudice. IT IS FURTHER ORDERED that plaintiff's motion for leave to file an amended complaint that was not prepared on a court-provided form [Doc. #6] is DENIED. MEMORANDUM AND ORDER: IT IS HEREBY ORDERED that the Clerk of Court shall terminate Matthew Wilson as a Defendant in this action. IT IS FURTHER ORDERED that Plaintiff's motion for appointment of counsel is DENIED. (Doc. No. 18.) IT IS FURTHER ORDERED that the complaint is dismissed for failure to state a claim with respect to Defendants T.J. Maxx, Inc., St. Louis County, and Nathaniel Jaeger, and process shall not issue as to these Defendants. IT IS FURTHER ORDERED that the Clerk of Court shall serve process on Defendants Trent Koppel and Daniel Milberg with respect to Plaintiff's excessive force claim.
