MEMORANDUM AND ORDER: Because it is clear under governing state law that the complaint does not state a cause of action against Hahn, the non-diverse defendant, joinder would be fraudulent. Accordingly, the motion to amend the complaint to add Hahn is DENIED, and this Court retains diversity jurisdiction over the case.
