MEMORANDUM AND ORDER: IT IS HEREBY ORDERED that Defendants' motions to dismiss, now considered motions for summary judgment, are DENIED without prejudice. (Doc. Nos. 16 & 22) IT IS FURTHER ORDERED that, on or after May 31, 2017, Defendants may file refile their motions for summary judgment, either incorporating by reference their previously filed memoranda in support thereof or attaching new supporting memoranda. IT IS FURTHER ORDERED that, pursuant to the Case Management Order (ECF No. 34), within 14 days of the date of this Memorandum and Order, the parties shall file a joint proposed schedule to address Phase II of this case, with class discovery and the filing of any motion for class certification with respect to the remaining claims to be completed in not more than six months.
