OPINION MEMORANDUM AND ORDER - IT IS HEREBY ORDERED that petitioners motion for leave to proceed in forma pauperis is GRANTED. IT IS FURTHER ORDERED that the petition for writ of habeas corpus is DENIED, and this action is DISMISSED. IT IS FURTHER ORDERED that the Court will not issue a certificate of appealability.
