MEMORANDUM AND ORDER: IT IS HEREBY ORDERED that Defendants' motion to dismiss is DENIED. ECF No. 8. However, this case is STAYED pending further order of the Court. IT IS FURTHER ORDERED that, no later than 14 days after final resolution of the class claims in Nio v. U.S. Dept of Homeland Sec., 323 F.R.D. 28 (D.D.C. 2017), the parties shall confer and Defendants shall file a notice advising the Court of the status of the case, any appropriate motion as to lifting of the stay, and a joint proposed schedule for the remainder of the litigation, if any. IT IS FURTHER ORDERED that this case shall be deemed closed administratively, for statistical purposes only, subject to reopening upon lifting of the stay or other appropriate Order.
