Judgment Amended: Reduction of Sentence Re: Crack Cocaine Offense 18:3582 as to Osker McNeal (1), Count 1, Upon motion of the Defendant under 18 USC 3582(c)(2) for a reduction in the Term of imprisonment imposed based on a guideline sentencing range that has subsequently been lowered and made retroactive by the United States Sentencing Commission pursuant to 28 USC 994(u) and having considered such motion, IT IS ORDERED that the motion is GRANTED and the defendant's previously imposed sentence of imprisonment (as reflected in the last judgment issued) of 211 months is reduced to 180 months. The reduced sentence is within the amended guideline range. This reduction reflects a revised calculation on Count I. It does not change the sentence on Count II which remains 60 months to be served consecutively to the sentence of Count I. Except as provided above, all provisions of the judgment dated February 25, 1994 shall remain in effect. 64 MOTION for Retroactive Application of Sentencing Guidelines to Crack Cocaine Offense 18 USC 3582 filed by Osker McNeal. Signed by Honorable Jean C. Hamilton on 5/19/08. (TRC)
