MEMORANDUM OPINION AND RECOMMENDATION OF UNITED STATES MAGISTRATE JUDGE JOE L. WEBSTER signed on 2/7/2014. Defendants have satisfied their burden to demonstrate that the Canadian forum is substantially more convenient. Therefore, this Court RECOMMENDS that the motion to dismiss pursuant to the doctrine of forum non conveniens (Docket Entry 26) be GRANTED and the action be DISMISSED, without prejudice to refilling in Canada. Further RECOMMENDING that, in the event the Court adopts this Recommendation, Defendants' motion to dismiss pursuant to Fed. R. Civ. P. 12(b)(2) (Docket Entry 24) be DENIED AS MOOT. (Daniel, J)
