ORDER as to defendant Benita Casares. It is ordered that: (1) The Federal Public Defender shall see to the appointment of counsel for Benita Casares. Counsel shall then enter his or appearance in this case and represent Ms. Casares. My chambers shall monitor this matter to see to it that counsel is appointed in a timely manner. (2) The United States shall file a response to Ms. Casares' motion no later than January 13, 2006. (3) Ms. Casares, through her counsel, shall then submit a reply to the government's submission no later than February 13, 2006. ORDER as to defendant Benita Casares. It is ordered that: (1) Counsel for the government shall notify the court when the motion for reduction in sentence pursuant to Rule 35(b) 55 is ripe for decision. The motion shall not be decided until counsel for the government certifies that the motion is ripe; (2) Counsel for the defendant, if previously appointed pursuant to the Criminal Justice Act, is reappointed to represent the defendant for purposes of the Rule 35(b) motion. If retained, counsel for the defendant remains as counsel for the defendant until the Rule 35(b) motion is resolved or until given leave to withdraw; (3) The Federal Public Defender shall provide CJA counsel with a new voucher; (4) The Clerk of the Court shall provide a copy of this order to counsel for the government and counsel for the defendant. ORDER as to Benita Casares. It is ordered that: (1) The defendant's motion to compel specific performance of the plea agreement and for hearing 51 is denied without prejudice because it has been mooted by the government's filing of a motion to reduce the defendant's sentence. Therefore, Ms. Casares is not required to submit a response as contemplated by my earlier order. 53 (2) The motion for appointment of counsel 51 is granted and Alan Stoler is appointed to represent the defendant regarding the government's motion 55 to reduce the defendant's sentence. The Federal Public Defender shall provide Mr. Stoler with a CJA voucher. Mr. Stoler shall promptly enter his appearance. (3) Government's counsel shall notify me when the motion to reduce the defendant's sentence 55 is ripe. (4) The Clerk's office shall provide copies of this memorandum and order to counsel for the government and Mr. Stoler.
