TENTATIVE FINDINGS OF FACT regarding Revised Presentence Investigation Report as to defendant Todd L. Parde. It is ordered that: (1) The defendant's motion 31 for departure (also construed as a motion for variance) pursuant to U.S.S.G. sec. 5K2.13 is denied. For among other reasons, the motion is denied because the evaluation by the Federal Medical Center at Rochester, Minnesota (FMC), upon which the defendant partially relies (31 at 2), conclusively refutes the assertion that the defendant now suffers from or has suffered from a significantly reduced mental capacity. In fact, the doctors at the FMC found that the defendant was malingering.
