JUDGMENT as to defendant Tracy Garrett Biggers (1). THE DEFENDANT pleaded guilty to counts I and II of the Indictment on 7/27/07. The defendant is hereby committed to the custody of the United States Bureau of Prisons to be imprisoned for a term of thirty (30) months. This sentence will begin today, October 12, 2007. Upon release from imprisonment, the defendant shall be on supervised release with special conditions for a term of three (3) years. The defendant shall pay the special assessment in the amount of $100.00. Final order of forfeiture forthcoming. PRELIMINARY ORDER OF FORFEITURE -The United States' Motion for Issuance of Preliminary Order of Forfeiture, filing 45 is hereby sustained. Based upon Count II of the Indictment and the Defendant's plea of guilty, the United States is hereby authorized to seize the Remington.22 caliber rifle, serial number 189674. The Defendant's interest in said property is hereby forfeited to the United States for disposition in accordance with the law, subject to the provisions of 21 U.S.C., ยง 853(n)(1). The aforementioned forfeited property is to be held by the United States in its secure custody and control.
