MEMORANDUM AND ORDER granting 2 Motion for Leave to Proceed in forma pauperis; Plaintiff shall pay an initial partial filing fee of $2.73 by November 9, 2007; After payment of the initial partial filing fee, the plaintiff's institution shall collect the additional monthly payments in the manner set forth in 28 U.S.C. ยง 1915(b)(2), quoted above, and shall forward those installments to the court. MEMORANDUM AND ORDER - Plaintiff Curtis Rush may proceed on his claims relating to deprivation of property without due process of law against Defendants Terry Weber and Jody Zimmering as set forth in this memorandum and order. The Clerk of the court shall send FOUR summons forms and FOUR USM-285 forms (for service on Defendants in both their individual and officialcapacities) to Plaintiff together with a copy of this memorandum and order. Plaintiff shall have until 4/11/08 to complete service of process. The Clerk of Court is directed to set a pro se case management deadline in this case with the following text: April 11, 2008: Check for completion of service of summons. Plaintiff shall keep the court informed of his current address at all times while this case is pending. MEMORANDUM AND ORDER - The Clerk of the Court shall change the name of Defendant "Jody Zimmering in the court's records to "Jodi Zimmerman." Defendants' Motion for Summary Judgment 33 is granted and Plaintiff's claims are dismissed with prejudice. Plaintiff's Motion for Summary Judgment 23 is denied.
