MEMORANDUM AND ORDER - The defendant is directed to show cause, on or before May 30, 2008, why this action should not be remanded to state court for lack of subject matter jurisdiction. MEMORANDUM AND ORDER - The defendant's motion to dismiss or, in the alternative, to stay the action and to compel arbitration (filing 2) is granted in part and denied in part, as follows: 1. The motion to dismiss is granted to the extent that the plaintiff's action is dismissed without prejudice, but in all other respects the motion to dismiss is denied. 2.
