MEMORANDUM AND ORDER-Hearing was held before me this date on the motion of the defendant, County of Furnas, for replevin. The court finds generally in favor of the defendant movant and against the plaintiff respondent on the motion for replevin. IT THEREFORE HEREBY IS ORDERED: Plaintiff shall, without damage or interference, deliver the property to the defendant forthwith. The defendant shall post, not later than 9:00 a.m. on August 22, 2008, cash or a surety bond to the benefit of the plaintiff in the amount of $10,000.00. The parties are given until September 3, 2008 to object to the bifurcation of this action to permit the scheduling of the trial on the replevin action as soon as practicable. MEMORANDUM AND ORDER - The defendant's motion to change the place of trial from Lincoln, Nebraska to North Platte, Nebraska, filing 9 Is granted. Trial of this case shall be held in North Platte, Nebraska. The plaintiff's motion to file an amended complaint, filing 17 is granted. On or before September 15, 2008, the plaintiff shall file his amended complaint, a copy of which is filed with his index of evidence in support of his motion to amend. The defendant shall file its response to the plaintiff's amended complaint within eleven days after the filing of the amended complaint. The parties' objections to bifurcation, filings 29 and 31, are granted.
