MEMORANDUM AND ORDER that the court has completed the initial review of the Defendant's Motion Under 28:2255; Upon intial review, the court finds that summary dismissal of the defendant's 2255 motion is not required; The United States shall file an Answer to claims 1 through 3 of the defendant's 2255 motion and support its answer with a brief; the defendant's motion for leave to proceed in forma pauperis 132 is granted; On or before February 19, 2007, the defendant may file a responsive brief; and the Clerk is directed to mail a copy of this Memorandum and Order to the defendant at his last known address as to defendant Rusty Leisure Case Management (Answer) Deadline set for 1/18/2007.
