ORDER SETTING SCHEDULE FOR PROGRESSION OF CASE AND ORDER ON MOTION TO QUASH. Deposition deadline set for 9/15/05. A proposed Order on Final Pretrial Conference shall be submitted to the court by January 30, 2006. The plaintiff shall keep the court informed of the plaintiff's current address at all times while this case is pending. Failure to do so may result in dismissal. The defendants' Motion to Quash 17 the plaintiff's request for production of documents, is denied as moot. The defendants have been properly served with process and have filed their answer. MEMORANDUM AND ORDER - That filing no. 24, the Motion to Dismiss Bellevue Police Department and to Amend Complaint filed by the plaintiff, Pete Lopez, is denied because neither the Bellevue Police Department nor the City of Bellevue is a named defendant in this case, and the requested consolidation of actions cannot be granted; That filing no. 27, the Motion for Summary Judgment filed by the defendants, Sarpy County, et al., is granted, and the above-entitled case will be dismissed withoutprejudice; That filing no. 33, Sarpy County's Motion to Vacate Scheduling Order, is granted; and That a separate judgment will be entered accordingly.
