MEMORANDUM AND ORDER - The Commissioner's motion to remand (filing 26) is granted to the extend that I grant remand, but denied to the extent that it seeks remand pursuant to sentence six of 42 U.S.C. § 405(g). The decision of the Commissioner is reversed and this action is remanded to the Commissioner pursuant to sentence four of 42 U.S.C. § 405(g) for consideration of the additional evidence timely submitted to but not considered by the Appeals Council. MEMORANDUM AND ORDER regarding motion. Plaintiff's application for attorneys fees and costs (filing 32) is granted in part and denied in part. Plaintiff's request for reimbursement of costs is denied without prejudice to the pending bill of costs (filing 39). By separate document, the court shall enter judgment for Plaintiff and against Defendant providing that Plaintiff is awarded attorneys fees in the amount of $5,688.80.
