PRELIMINARY ORDER OF FORFEITURE - The United States' Motion for Issuance of Preliminary Order of Forfeiture 32 is hereby sustained. The United States is hereby authorized to seize the $991.00 in United States currency, a Remington Model 1100 12 gauge shotgun, serial number L938017V, a Ruger Model 10/22.22 caliber rifle, serial number 110-37017, and a Wards Western Field Model 50 rifle. The Defendant's interest in said properties is hereby forfeited to the United States for disposition in accordance with the law. Upon adjudication of all third-party interests, this Court will enter a Final Order of Forfeiture, in which all interests will be addressed as to defendant Hector Garcia-Peliyo. JUDGMENT as to Hector Garcia-Peliyo. The defendant pleaded guilty to Counts I, III, IV, V of the Superseding Indictment and is committed to the custody of the Bureau of Prisons for 70 months on Count I and 70 months on Count IV. Counts I and IV are grouped pursuant to USSG 3D1.3(a); and shall be given credit for time served from 5/1/08. Supervised Release of 5 years on Count I and 3 years on Count IV to run concurrent with special conditions. $200.00 Special Assessment due immediately. The Indictment and Count II of the Superseding Indictment is dismissed on the motion of the United States. Final Order of Forfeiture as to Counts III and V forthcoming and the defendant shall forfeit to the United States: $991.00 in United States currency; a Remington Model 1100 12 gauge shotgun, serial number L938017V, a Ruger Model 10/22.22 caliber rifle, serial number 110-37017, and a Wards Western Field Model 50 rifle as to defendant Hector Garcia-Peliyo.
