PRELIMINARY ORDER OF FORFEITURE - The United States' Motion for Issuance of Preliminary Order of Forfeiture 33 is hereby sustained. The United States is hereby authorized to seize the Western Digital Hard Drive, CD labeled as stated in this Order. The Defendant's interest in said properties is hereby forfeited to the United States for disposition in accordance with the law. The aforementioned forfeited properties are to be held by the United States in its secure custody and control. Upon adjudication of all third-party interests, this Court will enter a Final Order of Forfeiture, in which all interests will be addressed as to defendant Mitchell L. Schultz. The defendant pleaded guilty to Counts I and III of the Indictment and is committed to the custody of the Bureau of Prisons for 72 months; and shall be given credit for time served. Supervised Release of 5 years with special conditions; $100.00 Special Assessment due and payable. Final Order of Forfeiture as to Count III forthcoming; and the defendant shall forfeit the following property: Western Digital Hard drive, CDs labeled as indicated in the order. Count II of the Indictment is dismissed on the motion of the United States as to this defendant only. The defendant shall surrender for service of sentence at the institution designated by the Bureau of Prisons no earlier than 12/4/09 as to defendant Mitchell L. Schultz.
