HABEAS ORDER ON INITIAL REVIEW - Upon initial review of the Petition for Writ of Habeas Corpus 1, the court preliminarily determines that the following claims as set forth in this Order are potentially cognizable in federal court. Petitioner's Motion for Appointment of Counsel 1 is denied without prejudice to reassertion. The Clerk of the court is directed to mail copies of this Memorandum and Order and the Petition for Writ of Habeas Corpus 1 to Respondent and the Nebraska Attorney General by regular first-class mail. By April 8, 2008, Respondent shall file a motion for summary judgment or an answer. The Clerk of the court is directed to set a pro se case management deadline in this case using the following text: April 8, 2008: deadline for Respondent to file answer or motion for summary judgment. MEMORANDUM AND ORDER - Petitioner shall have until August 11, 2008 in which to file a response to Respondents's Motion for Summary Judgment and Brief in Support. In the absence of a response, the court will rule on the Motion without further notice. In the event that Petitioner files a response, no later than 30 days after the filing of Petitioner's response, Respondent shall file and serve a reply brief.
