MEMORANDUM AND ORDER - Petitioners Motion to Extend Time to Correct Deficiency (Filing No. 9) is denied as moot; Petitioners Motion for Appointment of Counsel (Filing No. 1) is denied without prejudice to reassertion; Petitioners Motion to Amend Petition for Writ of Habeas Corpus (Filing No. 48 ) is granted; Petitioners Motion to Amend Petition for Writ of Habeas Corpus (Filing No. 7 ) is granted. Upon initial review of the Petition for Writ of Habeas corpus 1 and the Amended Petitions 5 and 7, the court preliminarily determines that the following claims are potentially cognizable in federal court: Claims One and Two as described in this Memorandum and Order; The clerk of the court is directed to mail copies of this Memorandum and Order, the Petition for Writ of Habeas Corpus and the Amended Petitions, to Respondent and the Nebraska Attorney General by regular first-class mail; By August 4, 2008, Respondent shall file a motion for summary judgment or an answer. The clerk of the court is directed to set a pro se case management deadline in this case using the following test: August 4, 2008: deadline for Respondent to file answer or motion for summary judgment; If Respondent files an answer or a motion the following procedures are set forth within the order.Ordered by Judge Laurie Smith Camp.
