MEMORANDUM AND ORDER 1. Plaintiff shall have until October 3, 2008 to amend his Complaint to clearly state an a claim upon which relief may be granted against Defendants, in accordance with this Memorandum and Order. If Plaintiff fails to file an amended complaint, Plaintiffs current Complaint (filing no. 1) will be dismissed without prejudice and without further notice for failure to state a claim upon which relief may be granted. 2. In the event that Plaintiff files an amended complaint, Plaintiff shall restate the allegations of the current Complaint (filing no. 1), and any new allegations. Failure to consolidate all claims into one document will result in the abandonment ofclaims. 3. The Clerk of the court is directed to set a pro se case managementdeadline in this case using the following text: Review amended complaint onOctober 3, 2008, dismiss if not filed. 4. The Clerk of the court is directed to send Daniel J. Rhoads the Civil Complaint Form. 5. Plaintiff shall keep the court informed of his current address at all times while this case is pending. MEMORANDUM AND ORDER - Defendants Dougherty and Mullen's Motion to Dismiss 19 is granted in part. All of the claims for monetary relief against these two Defendants are dismissed with prejudice. Plaintiff's claims for injunctive and declaratory relief against these two Defendants are dismissed without prejudice.The remaining Defendants' Motions to Dismiss 65, 67 and 69 are granted. Except for the claims against Defendants Dougherty and Mullen formonetary relief, Plaintiff's claims against all Defendants are dismissed without prejudice. A separate judgment will be entered in accordance with this Memorandum and Order. All other pending motions are denied. Ordered by Chief Judge Joseph F. Bataillon.
