ORDER - Garcia-Martinez's motion to continue trial 14 is granted. Trial of this matter is re-scheduled for August 10, 2009, before Chief Judge Joseph F. Bataillon and a jury. PRELIMINARY ORDER OF FORFEITURE- The United States' 24 Motion for Preliminary Forfeiture is sustained as to Teodoro Garcia-Martinez (1). Based upon Count III of the indictment and the defendant's plea of guilty, the United States is hereby authorized to seize $170.00 in US Currency. The Defendant's interest in said property is hereby forfeited to the United States for disposition. The aforementioned forfeited property is to be held by the United States in its secure custody and control. Pursuant to 21 U.S.C. § 853(n)(1), the United States forthwith shall publish for at least thirty consecutive days on an official Government internet site (www.forfeiture.gov) notice of this Order, Notice of Publication evidencing the United States intent to dispose of the property, Upon adjudication of all third-party interests, this Court will enter a Final Order of Forfeiture pursuant to 21 U.S.C. § 853(n), in which all interests will be addressed. FINAL ORDER OF FORFEITURE - The Plaintiff's Motion for Final Order of Forfeiture 38 is hereby sustained. All right, title and interest in and to the $170.00 in United States currency held by any person or entity, is hereby forever barred and foreclosed. The $170.00 in United States currency be, and the same hereby is, forfeited to the United States of America. The United States Marshal for the District of Nebraska is directed to dispose of said property in accordance with law as to defendant Teodoro Garcia-Martinez. Ordered by Chief Judge Joseph F.
