ORDER sustaining 26 Motion for Preliminary Forfeiture. The United States is hereby authorized to seize the Intrac Mak 90 Sporter rifle, serial# 9457987; KBI SKS-45 rifle, serial# RH032898; Remington.22 caliber rifle, serial# 2660822, a Glock Model 19 handgun, serial# KH408US, $20,100.00, $20,050.00 and$8,807.00 in United States currency. The Defendant's interest in said properties is hereby forfeited to the United States for disposition in accordance with the law, subject to the provisions of 21 U.S.C.§ 853(n)(1). The aforementioned forfeited properties is to be held by the United States in its secure custody and control. Upon adjudication of all third-party interests, this Court will enter a Final Order of Forfeiture pursuant to 21 U.S.C. § 853(n), in which all interests will be addressed as to Victor F. JUDGMENT as to Victor F. Mendoza-Hernandez (1). The defendant pleaded guilty to counts 1, 2 and 3 of the indictment and is committed to the custody of the Bureau of Prisons for a term of concurrent sentences of 57 months on Counts 1 and 2, which are grouped together pursuant to U.S.S.G.§ 3D1.2(c) with credit for time served; the defendant shall surrender for service of sentence no earlier than 12/18/09 by 2:00 p.m.; 3 years supervised release with special conditions on Count 1 and 3 years supervised release with special conditions on Count 2, to be served concurrently; $200 special assessment; and the defendant shall forfeit the defendant's interest in the following property to the United States: Intrac Mak 90 Sporter rifle, serial no. 9457987; KBI SKS-45 rifle, serial no. RH032898; Remington.22 caliber rifle, serial no. 2660822; and Glock Model 19 handgun, serial no. KH408US. On the motion of the government, Count 4 of the Indictment is dismissed.
