ORDER - This matter is before the Court on the notices of related case (Filing No. 18 in 8:09CR200; 19 in 8:09CR221. The government states the cases arise out of the same incident. Both are assigned to Senior District Court Judge Lyle E. Strom but currently are assigned to different magistrate judges. The Court finds the cases should be designated as related. United States of America v. Robert Taylor (8:09CR221) is referred to Magistrate Judge F.A. PRELIMINARY ORDER OF FORFEITURE - The United States' Motion for Issuance of Preliminary Order of Forfeiture41 is hereby sustained. Based upon Count II of the Indictment and the defendant's plea of guilty, the United States is hereby authorized to seize the Remington Model 597,.22 caliber rifle; a Ruger.22 caliber, Model 10/22 rifle; a Beretta CX4 Storm 9mm rifle; a Tikka T3 30-06 caliber rifle; a Romanian SKS rifle 5.45x39mm; a Ruger Model 10-22.22 caliber rifle; and a Russian SKS 7.62x39mm. Defendant's interest in said properties is hereby forfeited to the United States for disposition in accordance with the law, subject to the provisions of 21 U.S.C. § 853(n)(1). The aforementioned forfeited properties are to be held by the United States in its secure custody and control. Upon adjudication of all third-party interests, this Court will enter a Final Order of Forfeiture pursuant to 21 U.S.C. § 853(n), in which all interests will be addressed. JUDGMENT for Revocation of Supervised Release as to defendant Robert Taylor. Defendant admitted guilt to violation of Mandatory Condition of the term of supervision.
