Any claim asserted by Plaintiff Experian Marketing Solutions, Inc., as to the EXPERIAN service mark in Count I is dismissed with prejudice; Any claim asserted by Plaintiff Experian Information Solutions, Inc., as to the MOSAIC service mark in Count I is dismissed with prejudice; Plaintiff Experian Marketing Solutions, Inc., is granted leave to file a Second Amended Complaint on or before September 21, 2009, to clarify its rights to the MOSAIC service mark and to attach a copy of its license agreement for use of the MOSAIC service mark, and for no other purpose, In the absence of the filing of a Second Amended Complaint, any claim by Plaintiff Experian Marketing Solutions, Inc., as to the MOSAIC service mark in Count I will be dismissed; The Defendants will respond to any Second Amended Complaint within fourteen (14) days after service of the Second Amended Complaint, or, if no Second Amended Complaint is filed, the Defendants will respond to the First Amended Complaint on or before October 5, 2009; and The Motion to Dismiss is otherwise denied.
